1000913057 Ontario Ltd. o/a Pickleball Nation (“Pickleball Nation” or “Company” or “we” or “us” or “our”) is committed to protecting your privacy in accordance with applicable Canadian privacy laws, such as the Personal Information Protection and Electronic Documents Act, which sets the ground rules for how organizations may collect, use, or disclose your Personal Information throughout the course of business activities.  This Privacy Policy (the “Privacy Policy”) describes:

  • how we collect, use, disclose, and protect the Personal Information of our customers and website users (“you”);

  • describes the types of information we may collect from you or that you may provide when you visit www.thepickleballnation.ca (our “Website”); and

  • our practices for collecting, using, maintaining, protecting, and disclosing that information.

We will only use your Personal Information in accordance with this Privacy Policy unless otherwise required by applicable law. We take steps to ensure that the Personal Information that we collect about you is adequate, relevant, not excessive, and used for limited purposes.

The Website may include links to third-party websites, plug-ins, services, social networks, or applications. Clicking on those links or enabling those connections may allow the third party to collect or share data about you. If you follow a link to a third-party website or engage a third-party plugin, please note that these third parties have their own privacy policies and we do not accept any responsibility or liability for these policies. We do not control these third-party websites, and we encourage you to read the privacy policy of every website you visit.  This Privacy Policy DOES NOT apply to information that:

  • we collect offline or through any other means, including via any third-party website or application; and

  • you provide to or is collected by any third party, through any application or content (including advertising) that may link to or be accessible from or on the Website.

We are responsible for the protection of Personal Information in our custody or control. This Privacy Policy describes key principles and practices we follow with respect to our collection, use, disclosure, retention and disposal of your personal information, whether collected by us online, via telephone or mobile devices, mail, or any other means. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to people that we do not employ or manage.

Please read this policy carefully to understand our practices for collecting, processing, and storing your information. If you do not agree with our practices, your choice is not to use our Website. By accessing or using this Website, you indicate that you understand, accept, and consent to the practices described in this Privacy Policy. This Privacy Policy may be amended by us from time to time in order to address modifications to existing law, regulations, company policies or business practices. Any such amendments will be reflected in the Privacy Policy posted on our Website.  Your continued use of this Website after we make any changes indicates that you accept and consent to those changes. 

What is Personal Information?

Personal information (“Personal Information”) is information about you, and may include (without limitation) your name, address, birth date, email, telephone number, Internet Protocol (IP) address, user name, account number, billing and account information, personal credit or financial information, and any other information we may use to contact you. It reveals something of a personal nature about you, and it could reasonably identify you if disclosed (either on its own, or in combination with other information). Personal Information does not include your business contact information, such as your title, business address or business email address (when used for the purpose of communicating to you in relation to your employment or profession), or information that has been anonymized or aggregated so that it can no longer be used to identify you.  

What Personal Information Do We Collect?

We collect Personal Information from you online, over the telephone or by mail, and will inform you of the purposes for which we collect and use your Personal Information at the time of collection, or as otherwise set out in this Privacy Policy.  Types of Personal Information we may collect include:

  • identifying and contact information, such as your name, address, telephone number, e-mail address, and birth date;

  • certain information related to your request for certain products or services; 

  • financial information, such as credit card details or billing addresses;

  • information related to your use of our website, including internet service providers and Internet Protocol (IP) addresses of devices being used to access our website, operating systems and the types and versions of browsers used to access our websites, dates and times users access our websites, as well as website cookies; and

  • other information through your use of our Website, correspondence or discussions with us, and other mechanisms for transacting and communicating with us, including surveys. 

Why does Pickleball Nation Collect Personal Information?

We collect and use your Personal Information to perform our necessary business activities, including:

  • to process, verify, and deliver orders of products or services, including subscription services related to your membership, newsletters, marketing communications, or informational campaigns; 

  • to communicate with you regarding products or services, via email, SMS, text or by telephone; 

  • to manage our relationship with you;

  • to receive and respond to inquiries, and to improve our products and services; 

  • to permit you to register and access an account with us;

  • to identify and carry out improvements to the products and services we provide;

  • as permitted or as is necessary to comply with legal and regulatory requirements;

  • to deliver targeted marketing, service updates, and promotional materials based on your use of our Website or our products and services;

  • to measure the performance of our email marketing campaigns (e.g. by analyzing open and click rates);

  • to track and analyze trends and patterns impacting our business; 

  • to detect, prevent, mitigate and investigate fraudulent or illegal activities;

  • to create aggregated information that does not allow you to be personally identified or contacted; and

  • any other reasonable purpose, so long as your consent has been provided. 

How does Pickleball Nation Collect Personal Information?

We use different methods to collect your Personal Information, including through:

  • direct interactions with you.  For example, when you fill out forms or correspond with us by phone, email, or otherwise.  The information we collect directly from you on or through our Website may include:

    • information that you provide by filling in forms on our Website. This includes information provided at the time of subscribing to our service, registering to use the Website and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Website;

    • records and copies of your correspondence (including email addresses), if you contact us;

    • your responses to surveys that we might ask you to complete for research purposes;

    • details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website;

    • your search queries on the Website; and

    • information provided by you for the purposes of or with the intent to be published or displayed (hereinafter, “posted”) on public areas of the Website or transmitted to other users of the Website or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages for such information by logging into your account profile, please be aware that no security measures are perfect. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that unauthorized persons will not view your User Contributions.

    • to fulfill the purposes for which you provided the information or that were described when it was collected, or any other purpose for which you provide it;

    • to carry out our obligations and enforce our rights arising from any contracts with you, including for billing and collection or to comply with legal requirements;

    • to notify you about changes to our Website or any products or services we offer or provide through it;

    • to improve our Website, products or services, marketing, or customer relationships and experiences;

    • to allow you to participate in interactive features, social media, third party applications, or similar features on our Website;

    • to measure or understand the effectiveness of the advertising we serve to you and others, and to deliver relevant advertising to you;

    • to create aggregated, anonymized information for statistical purposes to identify trends and patterns related to our customers or products and services;

    • in any other way we may describe when you provide the information; and

    • for any other purpose with your consent.

We may use the information we have collected from you to enable us to display advertisements to our advertisers' target audiences. We may use aggregated, anonymized information collected for statistical purposes in order to, for example, identify the demographics of our customers, or to analyze trends and patterns. We may also disclose aggregated, anonymized data to third parties, but never any identifiable Personal Information (except in accordance with this Privacy Policy).

When does Pickleball Nation Disclose or Transfer Personal Information?

We may disclose or share your Personal Information with our employees, consultants, affiliated companies and other third parties that provide services to us, and who require it in order to ensure we are able to manage our relationship with you and provide you with products and services, as described in this Privacy Policy. Additionally, your Personal Information may be disclosed with your consent:

 

  • for the purposes described in this Privacy Policy;

  • to fulfill the purpose for which you provided it;

  • to our third party service providers (who may be located outside Canada) for purposes related to supporting our business, including (without limitation) IT service providers, payment processers, and advertisers or advertising networks;

  • as part of an audit by governmental or regulatory authorities;

  • as permitted or required by applicable law or regulatory requirements;

  • for any purpose disclosed by us when you provide the information;

  • during emergency situations or where necessary to protect the safety of a person; and

  • as part of a merger, acquisition, divestment or change in control of all or a part of our business.

We may also disclose your Personal Information:

  • to comply with any court order, law, or legal process, including in response to any government or regulatory request, in accordance with applicable laws;

  • to enforce or apply our Website Terms of Use, Membership Terms and Conditions, and other agreements, including for billing and collection purposes;

  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Pickleball Nation, our customers, or others. This includes exchanging information with third parties for the purposes of fraud protection and credit risk reduction.

We may also transfer Personal Information that we collect or that you provide as described in this Privacy Policy to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Website improvement and optimization) and who are contractually obligated to maintain confidentiality and use it only for the purposes for which we disclose it to them.  We may process, store, and transfer your Personal Information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your Personal Information through the laws of the foreign country.  By submitting your Personal Information or engaging with the Website, you consent to this transfer, storage, or processing.

Your Choices

Whenever possible, we strive to provide you with choices regarding the Personal Information you provide to us, including as follows: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this Website may not be accessible or may not function properly. 

  • Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by emailing us at info@thepickleballnation.ca

  • Promotional Offers from Pickleball Nation. If you have opted in to receive certain emails from us but no longer wish to have your contact information used by us to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to info@thepickleballnation.ca. If we have sent you a promotional email, you may unsubscribe by clicking the unsubscribe link we have included in the email.  This opt-out does not apply to information provided to Pickleball Nation as part of a purchase, warranty registration, product service experience, or other transactions.

  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt out by sending us an email stating your request to info@thepickleballnation.ca

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of several third party ad servers' and networks' cookies.  Opting out of a network does not mean you will no longer receive online advertising. It does mean that the network from which you opted out will no longer deliver ads tailored to your web preferences and usage patterns.

CHILDREN UNDER THE AGE OF 13

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any information to the Website. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on this Website or on or through any of its features/register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at info@thepickleballnation.ca.

How does Pickleball Nation Protect Personal Information?

The security of your Personal Information is important to us. We use reasonable physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. 

The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. You must not share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards, which any Website visitor can view.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

Except as otherwise permitted or required by applicable laws or other legal requirement, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

How can Personal Information be Accessed or Update?

Your Personal Information is just that – yours.  We will make reasonable efforts to ensure your Personal Information is accurate, complete and up-to-date, but should you wish to review, change or otherwise access any of your Personal Information held by us, please contact our Privacy Officer at info@thepickleballnation.ca.  Please note, however, that there may be times, or circumstances, where your Personal Information cannot be accessed or changed, such as if the information has been destroyed pursuant to our record retention policies. In such cases we will advise you of the reasons why your information cannot be accessed, subject to any legal or regulatory requirements we may otherwise have.  Please note that we will retain your Personal Information only for as long as necessary to provide you with the products and services you have requested, or for other essential purposes such as complying with applicable laws.

You have the right to refuse to give your Personal Information to Pickleball Nation.  By giving your Personal Information to Pickleball Nation you consent to your Personal Information being collected, stored, used, disclosed and processed in accordance with this Privacy Policy.  You may withdraw your consent at any time by contacting our Privacy Officer at info@thepickleballnation.ca.  If you choose to withdraw or refuse to give consent, Pickleball Nation may not be able to provide or continue to provide certain services or information to you.
